Our practice focuses on the federal law of patents, trademarks, and copyrights. We represent clients before the United States Patent and Trademark Office (USPTO) and the U.S. Copyright Office at every stage, from the first application through post-grant and post-registration proceedings.

Practice Before the USPTO

We prepare, file, and prosecute utility and design patent applications through examination to allowance and issuance. We also file and prosecute trademark applications through examination to registration on the Principal and Supplemental Registers.

Our work continues after a patent issues or a trademark registers. For patents, we handle maintenance fee payments and certificates of correction. For trademarks, we prepare and file Section 8 declarations of continued use, Section 9 renewal applications, Section 15 declarations of incontestability, and amendments to registrations.

We file petitions with the USPTO, pursue ex parte appeals before the Patent Trial and Appeal Board (PTAB), and handle ex parte reexamination and reissue proceedings. When they suit a client's goals, we also use the USPTO's pilot and expedited examination programs for utility and design patent applications.

Our practice reflects the changes made by the America Invents Act (AIA), including first-inventor-to-file practice and supplemental examination. We represent clients in PTAB trials, including inter partes review (IPR), post-grant review (PGR), and derivation proceedings.

Practice Before the U.S. Copyright Office

We provide copyright registration and counseling before the U.S. Copyright Office. We help clients register their works and advise them on protecting their copyrights.
